The Dilemma: Find My iPhone

Sam Sheffer downed late-night beers with his brother at a New York City bar when he realized his iPhone had been stolen from the back pocket of his jeans. Luckily, he had installed the Find My iPhone app. He hastily downloaded the same app to his brother’s device, which allowed him to see that his stolen phone was somewhere in the noisy bar. At closing time, the bar emptied and the app indicated that his stolen phone was now across the street. He shadowed a man while hitting the Play Sound button, until he heard his stolen phone ringing inside the guy’s jacket pocket.

Sam was bent on personally retrieving his iPhone, but is such a move justified? What do you say?
